Terms of Service
These Terms of Service ("Terms") govern your access to and use of the Pulsevia website, mobile applications, AI interview, test panels, dashboard and related services (together, the "Services") provided by Pulsevia Inc., a Delaware corporation with its registered address at 711 S Dearborn, Chicago, IL 60605, USA ("Pulsevia," "we," "us").
By creating an account or using the Services you agree to these Terms. If you do not agree, do not use the Services.
1. Who we are
Pulsevia provides a wellness and longevity platform that uses artificial intelligence to recommend blood biomarker panels, track results and connect users with licensed healthcare professionals for optional telemedicine consultations. Laboratory testing and consultations are performed by independent third-party partners.
2. Not medical advice — required acknowledgement
Pulsevia is a wellness product, not a medical device. Our AI interview, panel recommendations, dashboard explanations and trend summaries are provided for informational and lifestyle purposes only. They do not constitute medical diagnosis, treatment, prescription or professional medical advice.
By using the Services, you expressly acknowledge and agree that:
- Pulsevia is not your doctor. The AI agent, the platform and any written explanations are not a substitute for a qualified, licensed healthcare professional.
- The AI can be wrong. AI output may be incomplete, inaccurate or inappropriate for your situation; you will not rely on it for any medical decision.
- No diagnosis or treatment. Results and recommendations shown in Pulsevia do not diagnose, treat, cure or prevent any disease. Only a licensed physician can do that — during a telemedicine consultation or in person.
- Consult a physician. You will consult a qualified physician before acting on any information from the Services, especially before starting, stopping or changing any medication, supplement, diet or exercise programme.
- Emergencies. Pulsevia is not for emergencies. In an emergency, call your local emergency number (for example 911 in the US) or go to the nearest emergency department.
- You remain responsible. You are solely responsible for any action you take based on information provided through the Services.
If you do not agree to each of the points above, you must not use the Services.
3. Eligibility
You must be at least 18 years old and legally able to enter into a binding contract to use the Services. You represent that the information you provide is accurate and current.
4. Accounts
You are responsible for your account credentials and for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorised access.
5. Subscriptions, payments and refunds
Services are offered on a subscription basis. Subscription fees, draw counts and included features are described on our pricing page and at checkout. Fees are charged in advance and renew automatically until cancelled.
- You may cancel a subscription at any time from your account; cancellation takes effect at the end of the current billing period.
- Unused tests from an expired period do not roll over unless expressly stated.
- Because certain Services (for example, ordered lab draws, kits or consultations) are personalised and non-returnable, refund rights may be limited once a draw has been scheduled or a kit has been dispatched.
6. Lab testing and telemedicine
Blood draws, laboratory analysis and telemedicine consultations are delivered by independent licensed partners. Your relationship with those partners is governed by their own terms, and they are solely responsible for the clinical services they provide. Pulsevia is not a laboratory or healthcare provider and does not practice medicine.
7. AI features
Parts of the Services (including the voice interview and panel recommendations) are powered by artificial intelligence. AI output can be incorrect, incomplete or inappropriate for your situation. See our AI Policy for more information.
8. Acceptable use
You agree not to: (a) use the Services for any unlawful purpose; (b) attempt to reverse engineer, scrape or disrupt the Services; (c) submit false information, including about another person; or (d) resell or redistribute the Services without our written consent.
9. Intellectual property
The Services, including all software, content, trademarks and designs, are owned by Pulsevia or its licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable licence to use the Services for your personal, non-commercial use.
Your test results and personal data remain yours. By using the Services you grant Pulsevia a licence to process that data to deliver the Services as described in our Privacy Policy.
10. Disclaimer of warranties
The Services are provided "as is" and "as available" without warranties of any kind, either express or implied, including merchantability, fitness for a particular purpose, non-infringement or accuracy of AI-generated content, to the maximum extent permitted by law.
11. Limitation of liability
To the maximum extent permitted by law, Pulsevia's aggregate liability arising out of or relating to the Services will not exceed the greater of (a) the amount you paid Pulsevia in the twelve months before the event giving rise to the claim, or (b) USD 100. Pulsevia will not be liable for any indirect, incidental, special, consequential or punitive damages.
12. Indemnification
You agree to indemnify and hold Pulsevia harmless from any claim arising out of your misuse of the Services or violation of these Terms.
13. Termination
We may suspend or terminate your access to the Services at any time for breach of these Terms or for risk to other users or the platform. You may close your account at any time by contacting [email protected].
14. Changes to these Terms
We may update these Terms from time to time. Material changes will be notified by email or in-app notice at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
15. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws principles. Any dispute will be resolved exclusively in the state or federal courts located in Delaware, unless binding consumer protection law requires otherwise.
