Welcome to Pulsevia! These Terms and Conditions govern your use of our website, products, and services, including subscriptions, devices, and related offerings. By accessing our website or purchasing our products, you agree to comply with these terms.


1. Definitions

  • “Pulsevia” refers to Pulsevia Inc, doing business as Pulsevia.

  • “Services” refer to the Pulsevia device, subscription plans, and related software and platforms.

  • “User” or “You” refers to any individual accessing or using Pulsevia’s products or services.

  • “Device” refers to the Pulsevia watch or other hardware provided or sold by Pulsevia.


2. Subscription Terms

Subscription Activation

Subscriptions begin upon activation of your Pulsevia device and completion of any applicable free trial period.

Recurring Payments

By purchasing a subscription, you authorize Pulsevia to automatically charge your selected payment method on a recurring basis (monthly or annually, as selected).

Cancellation Policy

You may cancel your subscription at any time via your account dashboard or by contacting Pulsevia support. If you cancel during a billing cycle, your subscription will remain active until the end of the current billing period. No further subscription charges will be made after cancellation.

Subscription Refunds

Subscription fees are non-refundable once a billing period has begun, except where required by applicable law or as expressly stated in these Terms.


3. Free Trial and Promotional Offers

Free Trial

Eligible new users may receive a free trial subscription as specified at the time of purchase. Trial eligibility and duration may vary.

Promotional Hardware Offers

In some promotions, Pulsevia may provide a Device at no upfront cost (“Free Device”) contingent upon maintaining an active subscription.

If the subscription is cancelled during or after the trial or initial subscription period, the Free Device must be returned in accordance with Section 7 below to be eligible for any applicable refund.

Pulsevia reserves the right to modify or discontinue promotional offers at any time.


4. Device Ownership and Usage

Device Ownership

  • Devices purchased outright are owned by the customer.

  • Devices provided at no upfront cost as part of a promotional or subscription-based offer remain the property of Pulsevia unless otherwise stated.

Device Warranty

Devices are covered by a 1-year limited warranty. Damage caused by misuse, unauthorized repair, or modification is not covered.

User Responsibility

You are responsible for proper care, use, and safeguarding of the Device while it is in your possession.


5. Data Usage and Connectivity

Connectivity

Pulsevia Devices include built-in cellular connectivity as part of the subscription. Connectivity availability depends on carrier coverage and location.

Data Consent

By using the Services, you consent to the collection and processing of data as described in our Privacy Policy.


6. Limitation of Use

Non-Medical Use

Pulsevia Services are not intended to provide medical advice, diagnosis, or treatment and should not be relied upon as such.

User Responsibility

You are responsible for how you respond to alerts and for using the Services appropriately.


7. Returns and Refund Policy

Device Returns

Pulsevia offers a 30-day return window from the date of delivery.

To qualify for a return:

  • The Device must be returned in good working condition, with all accessories.

  • The customer is responsible for all return shipping costs. Pulsevia does not provide prepaid return labels.

Refunds Involving Free or Promotional Devices

If a Device was provided free of charge as part of a subscription or promotional offer:

  • Any refund issued during an active or recently cancelled subscription is conditional upon the return of the Device.

  • If the Device is not returned within 30 days of cancellation, Pulsevia reserves the right to deduct a $200 USD hardware fee from any refund or charge this fee to the payment method on file.

  • No refund will be processed until the Device has been received and inspected by Pulsevia.

Refund Processing

Approved refunds will be issued within 14 days of receiving the returned Device. Subscription fees remain non-refundable except as required by law.


8. Modifications to Services and Pricing

Pulsevia may update service features, subscription plans, or pricing at any time. Material changes will be communicated via email or account notifications. Continued use of the Services constitutes acceptance of updated terms.


9. Dispute Resolution

Governing Law

These Terms are governed by the laws of the State of Delaware.

Arbitration

Any disputes shall be resolved through binding arbitration administered by JAMS, rather than in court.


10. Indemnification

You agree to indemnify and hold harmless Pulsevia from any claims, damages, or losses arising from your use of the Services or violation of these Terms.
